NO INSURANCE:
In the event that you do not have your own automible insurance: or are not listed under someone else's policy, but have been injured in an automobile accident, you can still make a claim for Accident Benefits (limited benefits available if driving without insurance). The circumstances will determine which insurance company is responsible for paying for the Accident Benefits that you may be entitled to.

If you don't have automobile insurance or are not listed under someone else's policy, and no other automobile involved in the accident has automobile insurance or can be identified, you may be entitled to obtain Accident Benefits from Ontario's Motor Vehicle Accident Claims Fund (MVACF). We can assist you in obtaining benefits under these circumstances.

RETAINING THE SERVICES OF A PARALEGAL

There are some important facts that you should consider prior to retaining the services of a Paralegal to assist you in making an Accident Benefits claim.

WHAT IS A PARALEGAL ?

A Paralegal is a P1 licensee who provides legal services in the Province of Ontario, that are permissible by the Paralegal Licensing granted by the Law Society of Upper Canada.

WHAT SERVICES CAN A PARALEGAL PERFORM ON YOUR BEHALF ?

Paralegals may perform a variety of services on your behalf, including:

  • advising you about your rights under the Statutory Accident Benefits (SABS)
  • completing or assisting in completing application forms
  • discussing the case or negotiating with an Insurer or Adjuster
  • attending Dispute Resolution Proceedings at Financial Services Commision of Ontario (FSCO), in Small Claims Court, or in a private arbitration, and
  • negotiating the settlement of Accident Benefits claims

REQUIREMENTS FOR PARALEGALS

Paralegals providing any of the above services to Accident Benefits claimants are required hold a P1 license to provide legal services that are permissible by the Paralegal Licensing granted by the Law Society of Upper Canada. If they do not, they are not allowed to provide these services. Accident Resolution Group has 10 P1 licensee Paralegals making our firm the largest Accident Benefits Paralegal Firm in Canada.

Paralegals in order to hold/mantain the P1 license MUST:

  • pass a criminal record check
  • be of good character
  • adhere to the Paralegals Rules of Conduct (LSUC)
  • be a paralegal in good standing the Law Society of Upper Canada
  • carry "Errors and Omissions" liability insurance
  • comply with other regulatory requirements
